Costs Orders and Bills of Costs in LawServa track the costs side of litigation. Costs Orders is a register of every order the court makes about costs, showing how much your clients must pay and how much they are owed. Bills of Costs lets you draw a bill from the time and disbursements already on the file, then record its filing, taxation or agreement. They are used by litigation lawyers, clerks, accounts staff and the partner who watches overdue orders.
Before You Start
Costs Orders and Bills of Costs each have their own permission. Both are tabs of Billing under Money. You can also open either one from a matter record, where it shows only that file.
The Costs Order Register
The figures at the top show what Our Clients Owe, what Our Clients Are Owed, and how many orders are Past Their Date. Below them, the register lists each order with its Order, Matter, Who Pays, Amount, Payable By, Status and an Action button.
By default the register shows Outstanding orders. Use Search, Status and Who Pays and press Filter, or choose All.

Recording a Costs Order
Open Billing, then the Costs Orders tab.
Press Record Costs Order. The Record a Costs Order dialog opens.
Choose the Matter and enter What the Order Was Made On, such as the application or hearing.
Enter the Date of the Order and the Court.
Under How the Court Put It, choose the term, for example Costs Fixed at a Sum, Costs to Be Taxed, Costs in the Cause, Costs Reserved, Costs Thrown Away or No Order as to Costs.
Under Who Was Ordered to Pay, choose Our Client Pays, Our Client Receives or Nothing Payable Now.
Enter the Sum Ordered (RM). Leave it blank where the costs are to be taxed; LawServa records it as not yet quantified, never as nil.
Enter Payable By, choose the Basis if the order states one, and add any Note.
Press Record It.
Where your client is the one ordered to pay and a date is given, LawServa puts that date in the file's diary as a critical entry.
Updating a Costs Order
Press Open on the order, then use the section you need:
Put the Taxed or Agreed Figure On It: enter the Sum Taxed or Agreed (RM) and Payable By, then press Record Figure.
Record That It Has Been Paid or Record That It Has Been Received: enter the date and amount, then press Mark Paid or Mark Received. The amount can differ from the sum ordered, and the register shows both.
Correct the Details: change the order and press Save Changes.
To close an order that will not be paid, choose Which outcome applies, enter Why and press Conclude.
If the order was recorded by mistake, enter Why and press Withdraw.
Bills of Costs
The Bills of Costs list shows each bill with its number, matter, basis and status. By default it shows bills that are Drawn, Filed or Part Taxed. Use Search and Status and press Filter, or choose All.

Drawing a Bill
Open Billing, then the Bills of Costs tab.
Press New Bill. The Draw a Bill of Costs dialog opens.
Choose the Matter, and enter What This Bill Is For.
Choose the Basis of Taxation: Party and Party, Solicitor and Client or Indemnity.
Enter the Court and Suit Number, and any Note.
Press Draw Bill.
Building the Items
On a draft bill, the Draw the File In panel builds the bill from what is already on the file:
Draw In Time brings recorded time in as Part I items. Move any attendance before a judge into Part II yourself.
Draw In Disbursements brings in the file's disbursements.
Add Item adds an item by hand: choose the Part, enter the Date, Work Done and Amount Claimed (RM), then press Save Item.
Edit Heading changes the bill's title, basis, court or suit number.
Items are grouped as Part I (work done in the cause or matter), Part II (work done in court), Part III (work done for and in the taxation) and Disbursements. Part III items are added with Add Part III Item while the bill is filed or part taxed. Drawing the file in does not mark anything as billed and does not change the client's own invoice.
Filing, Taxation and Agreement
Under Filing and Taxation:
Press Record Filing, enter the Date Filed and the Bill Number in Court, and press Record Filing.
After the hearing, press Record Taxation. Enter the Date of Taxation, the amount allowed on each item and any Registrar's Note, then press Record Taxation. The bill reads Part Taxed until every item has been ruled on.
If costs are settled instead, press Costs Agreed, enter the Amount Agreed (RM), Date Agreed and a Note, and press Record Agreement.
To abandon a bill, press Withdraw Bill, enter Why and confirm with Withdraw Bill.
Press Download PDF to produce the bill in the Order 59 form on A4.
Frequently Asked Questions
Why Does a Costs Order Show No Amount?
The costs are to be taxed or have not yet been quantified. Use Put the Taxed or Agreed Figure On It once the figure is known.
Does Marking a Costs Order Paid Move Client Money?
No. It only records that the order was satisfied. Record any actual receipt or payment in the client account or on the bill.
Can I Edit a Bill of Costs After It Is Filed?
Items are built while the bill is a draft. After filing you can add Part III items and record the taxation or agreement.
Where Do the Time Figures Come From?
Draw In Time uses the time entries already recorded on the matter, so record time as you work.
